Rules and regulations for courses

Hardware and software

During a Bakabaka Design course, you will work on your own computer, using Adobe CC software. What software you will use depends on the specific course. In the course contract and the confirmation, I will tell you clearly what software you will need.

You are responsible for bringing a computer with a license for the software we agreed on. The computer and the software license are explicitly excluded from the course fee. Do take into account that software like Adobe CC or Affinity is not free. License fees for Adobe software can be found on their website. Take care of updating your software and make sure it is working when you follow the course.

In case of a course in a group, I will take care of providing a power socket so you can plug in your computer if need be.

 

Materials provided

All the digital material that I provide during a course, is included in the course fee. This will mainly concern summaries, examples, and slide decks. This material is copyrighted by Bakabaka Design, and you are explicitly prohibited from distributing it.

Should you want to do sketches by hand with paper and pencil, pen, or sharpie, I kindly ask you to bring along those materials yourself.

 

Confidentiality and copyright

You own the copyright of any materials you create during a course. If you are following the course through your employer, then your employer holds the copyright to materials you make during the course, instead of you yourself. This regulation is an exception to my General Terms and Conditions, clauses 12.1, 12.2, and 12.3. These clauses are not applicable to material course followers create during a course.

I will treat with confidentiality all material your provide and create during a course. If I have a need to save those materials, they will be stored in a secure location. No longer than ninety days after the end of the course, I will delete them.

I own the copyright of any material I send you during the course. You are allowed to use these materials as a personal reference. You are not allowed to distribute them to other parties.

 

Services rendered

Besides the development and the teaching of your course, I’m also happy to advise and help with any design tasks, both during and after the course. Do not hesitate to ask for this help or advice. I cannot spend more time on this service than 10% of the total duration of your course. Should your request for help or advice exceed that amount of work, I will happily provide you with a quote for those services, or for an additional session of your course.

 

Payment, duration and termination

In the case that the total amount of your course fee is €600 (excluding VAT) or more, I will send you an invoice for a down payment in advance of the course. This down payment will amount to 20% of your total course fee. You can not participate in your course as long as you have not fulfilled this down payment.

Only after the last session of your course, will I send you an invoice for the remaining 80%. I expect you to fulfil these payments within 15 days, by bank transfer. You can find my bank account data on the contact page and on my invoices.

Courses never last longer than three months. This counts the date of the first session as the start of the course, and that of the last session as the course’s end. We can deviate from this maximum length in our written agreements.

If we do not deviate from this standard duration, and you have not yet finished the course three months after the first session, then the contract will terminate automatically. At that moment, I will invoice you for all of the sessions in the past you attended or were supposed to attend. I expect this situation to occur only when we decide to postpone planned course sessions, but we fail to agree upon a new date within the three-month time limit.

 

Cancellation

You will always receive a digital pdf as a quote for your course. After you have approved this quote, there is a period of 14 days during which you can cancel the course without any fee. Cancelling is only allowed per e-mail or per written, physical mail.

Do you want to cancel, but those fourteen days have already passed? That is possible, but I will invoice you a part of the fee.

Private courses

  • If you cancel a private course between 14 and 7 days before the first session, I will invoice you 50% of the fee for the preparation and development of the course. The preparation and development fee is defined in your quote. You will not pay any fee for sessions you have not attended.
  • If you cancel a private course 6 days before the first session or later, I will invoice you for 100% of the preparation and development costs, as well as 50% of the fee for the first session. If there were later sessions planned for your course, you will not pay any fee for those sessions.

Group courses

  • If you cancel your registration for a group course between 28 and 15 days before the first session, I will invoice you for 100% of the quoted amount for the first session. You will not pay any fee for any later sessions.
  • If you cancel your registration for a group course within 14 days before the first session, I will invoice you for 50% of the total course fee as quoted.

If you cancel your registration for a course, you explicitly waive the right to receive any material that you’d normally receive during the course.

 

Quitting

Do you want to quit a course after it has started? That is possible, but you will always pay a fee. Always communicate your decision to quit to me by e-mail. I will invoice you for all sessions of your course that were planned before the date I received your message, and for all sessions that were planned within 21 days after that date. You will not play for any sessions that were planned 22 days after the date of receipt, or later.

In case you quit your course, you will stop receiving any material that belongs to the course sessions you haven’t attended.

In case you quit a course before you have attended the first session, then we call that a cancellation. See the rules and regulations under ‘Cancellation’ above.

 

Presence

Are you unable to attend a planned session for a private course? Inform me as soon as possible by e-mail, and we will plan a new date.

Are you unable to attend a planned session for a group course? Inform me by e-mail as soon as possible. Absences are at your own risk, you have no right to restitution if you are absent. Please pay close attention to the planning when reviewing and approving a quote!

In the case you missed a session of a group course, you are still entitled to receive the materials that accompany that session. I will send you those materials as normal. Read and study those materials well, and ask me any questions per e-mail, if needed. If you deem it necessary, we can agree to meet some 15 minutes earlier for the next course session, and I can get you up to speed about the subject matter you missed.

 

Evaluation

After the course, I’ll ask you to fill out a digital evaluation form about the course. This is voluntary, you are by no means obliged to do this. The form is anonymous, so it is not possible for me to deduce who sent in which evaluation. Well, if you fill out the form to give feedback about a private course, it’s going to be relatively easy to deduce anyway. My apologies.

If you have remarks that do not fit in the form, or if you want to discuss your feedback on the course, feel free to get in touch. Obviously, that will no longer be anonymous.

 

Complaints

If you have a formal complaint about a course, I’d prefer to come to an agreeable solution together. Get in touch by e-mail or regular mail, or fill out the complaint form. I will confirm receipt of your complaint within 5 working days. In the unlikely case that I’m on a holiday the moment you send your complaint, my autoresponder will tell you the date I’m planning to be available again. Only after that date can I receive your complaint.

Within 14 days after receipt of your complaint, I will send you a reaction. All complaints and related documentation, I will treat confidentially.

In the unlikely case we cannot come to an agreement about your complaint, we can submit our case to an independent mediator. I have found a legal mediator willing to take these cases: mr. H.J. Bodifée, Eendrachtsweg 45b, 3012 LD Rotterdam, the Netherlands, info@hbodifee.nl. I will submit to any judgments mr. Bodifée makes in mediation for complaints about my courses.

I will store all correspondence about your complaint for one full year after resolution. Exceptions to this period are situations where other institutes or the Law require me to store this data for longer than a year.
